SERIES 7000 - BUSINESSES AND TRADES

        

 CHAPTER 7070 - Taxicabs

 

         AN ORDINANCE TO AMEND THE VILLAGE OF LAKE LINDEN CODE SERIES 7000,  CHAPTER 7070 - TAXICABS, AND TO PROVIDE PENALTIES AND SANCTIONS FOR THE VIOLATION THEREOF.

                 

THE VILLAGE OF LAKE LINDEN ORDAINS:

       

   Section 1.   Taxicab License.

         No person shall engage in the business of operating or causing to be operated, any taxicab upon the streets, alleys, or public ways of the Village of Lake Linden without having first obtained a license for each such taxicab permit. No such license shall be granted except upon certification of the Village Chief of Police and upon approval of the Village Council. Upon application made for any new taxicab license, as distinguished from any renewal thereof, the Council shall first consider the question of whether public con-venience and necessity require the operation of such taxicab. The Council shall consider the number of taxicabs operating in the Village and whether the demands of the public require additional taxicab service; traffic conditions on the streets of the Village and whether the additional taxicab service will result in a greater hazard to the public and such other relevant facts as the Council may deem advisable. The judgment of the Council on the question of public necessity and convenience shall be conclusive.

        

   Section 2.   Insurance.

         Before any such license is issued, the applicant shall furnish one or more policies of insurance, prepaid for at least the period of the license, issued by insurance companies authorized to do business in the State of Michigan, providing indemnity for the insured in the amount specified therein and agreeing to pay, within the limits of said amounts on behalf of the insured, all sums which the insured shall become obligated to pay by reason of liability imposed upon the insured by law, for damages because of bodily injury, including death, at any time resulting therefrom or for damages to property, or both, sustained by any person and caused by accident and arising out of the ownership, maintenance or use of said licensed taxicab.

        

         The minimum amount of residual bodily injury insurance coverage as to any one licensed taxicab shall be:

        

(1)     On account of injury to, or death of, any person in any one accident:   $250,000

 

             (2)  On account of any one accident resulting in injury to, or death of, more than one                 person:        $500,000

         

         The applicant must also have in force coverage under the Michigan No- Fault Automobile        Insurance Act, MCLA 500.3101, et seq., and any amendment thereof, by an insurer authorized to do business in the State of Michigan for accidental bodily injury arising out of the ownership, operation, maintenance or use of a motor vehicle.

        

   Section 3.   Cancellation Notice.

         Every such insurance policy shall contain a clause obligating the insurer or surety to give  the Village Clerk, by certified mail, at least thirty (30) days written notice before the cancellation, expiration, lapse or other termination of such insurance or bond or the withdrawal of surety from any such bond.

        

   Section 4.   License Transfers.

         When the ownership of any taxicab shall change whether by operation of law or otherwise, the taxicab license pertaining to such taxicab shall be automatically revoked. Any transfer or attempt to transfer of a taxicab license to any other person shall automatically revoke the license.

 

   Section  5.  Transfer between Vehicles.

         The Owner of any licensed taxicab who desires to transfer such license to another vehicle owned by him, shall make application to the Village Clerk and shall state under oath or affirmation such facts as may be required for, or applicable to, such transfer. Upon approval of the Village Council, such transfer shall be granted.

 

   Section 6.  Unused Licenses.           

         In addition to the grounds for suspension and revocation of licenses in Chapter 7000 of this Code, the fact that the owner shall cease to operate any taxicab for a period of third (30) days Without having obtained permission for cessation of such operation from the Village shall Constitute an automatic revocation of the license for such taxicab.

        

   Section 7.  Passengers.   

         No driver or owner of a taxicab shall refuse or neglect to convey any orderly person or  persons upon request by signal or telephone call, unless the taxicab is Previously engaged. When a taxicab has been engaged by a Passenger, no additional Passengers shall be received therein except With the express consent of the first passenger. No persons other than Passengers for hire, except employees or members of the immediate family or any person licensed hereunder to engage in the business of Operating a taxicab, shall be transported therein.

        

   Section 8.  Rules and Regulations.

         The Village Council shall be empow~red to make such rules and regulafjo~5 regarding the dress and conduct of drivers, and the maintenance and marking of taxicabs, as may be necessary in the interest of Providing safe and orderly service to Passengers, and no person shall fail to comply with any such publication.

         within fifteen (15) days after the passage of Series 7000 - BUSINESS AND TRADE,

         Chapter 7070 -- Taxicabs, as amended, of the Code of the Village of Lake Linden, a

         copy of the Amended Ordinance was published in the Daily Mining Gazette, a

         newspaper circulated within the Village of Lake Linden, County of Houghton, Michigan

         on the 14th day of August, 1996, as more particularly appears in the

         attached Publisher’s Affidavit.
