ORDINANCE SERIES 4000 - CHAPTER 4020A

        

 AN ORDINANCE FOR THE PROTECTION OF THE HEALTH, SAFETY  AND WELFARE OF THE INHABITANTS OF THE VILLAGE OF LAKE LINDEN BY THE REGULATION OF TRAFFIC, THE USE OF STREETS, PUBLIC ROADS, SIDEWALKS AND PUBLIC PARKING LOTS, AND STOPPING, STANDING OR PARKING THEREON IN THE VILLAGE AND TO REPEAL CHAPTER 4020 OF SERIES 4000 OF THE VILLAGE OF LAKE LINDEN CODE RELATING TO “WINTER PARKING OF VEHICLES UPON THE STREETS” AND TO ENACT IN ITS PLACE AND STEAD CHAPTER 4020A OF SERIES 4000 OF SAID CODE,  AND TO PROVIDE FOR PENALTIES FOR THE VIOLATION THEREOF.

        

THE VILLAGE OF LAKE LINDEN ORDAINS:

               

Section  I.

         Chapter 4020 of Series 4000 of the Lake Linden Village Code entitled “Winter Parking of       Vehicles upon the Streets” is hereby repealed

        

Section  II.

          It shall be unlawful for any person to stop, stand or park a vehicle, or to cause or to permit a vehicle to be parked or left unattended at any time upon the highways, streets, roads or sidewalks in the Village, which shall block, impede or otherwise interfere with the flow of vehicular or pedestrian traffic thereon

        

Section  III.

           It shall be unlawful for any person to stop, stand or park a vehicle, or to cause or to  permit a vehicle to be parked or left unattended upon the highways, streets, roads or sidewalks in the Village between the hours of 3 A.M. and 7 A.M. of any day during the period from November 1 through April 30 of any given year hereafter.

        

Section IV.

           It shall be unlawful for any person to stop, stand or park a vehicle, or to cause or to  permit a vehicle to be parked or left unattended in any public parking lot owned or maintained by the Village between the hours of 3 A.M and 7 A.M. of any day during the period from November 1 through April 30 of any given year hereafter.

        

Section  V.

           It shall be unlawful for any person to stop, stand or park a vehicle, or to cause or to permit a vehicle to be parked or left unattended in any public parking 1ot owned or maintained by the Village during the period from May 1 through October 31 of any given year hereafter for a period in excess of twenty-four hours without first having obtained a written permit to do so from the Village Chief of Po1ice.

        

 

Section  VI.

           The term “vehicle” as used herein shall include any motor vehicle, motorcycle, motor    driven cycle, trailer, tractor, mobile home, snowmobile, accessory or device attached thereto, as defined in the Michigan Motor Vehicle Code, Michigan Compiled Laws Annotated § 257.1, et seq.

        

Section VII.

            In any proceeding for violation of the provisions of this Chapter, the registration plate displayed on the vehicle, or other evidence of identification, shall constitute a presumption  that the owner of such vehicle was the person who parked or placed such vehicle at the point where the violation occurred.

        

Section  VIII.

           Any vehicle parked in violation of this Chapter may be removed by direction of the Village and impounded. Any vehicle so impounded by the Village shall not be released to the owner until all parking charges, storage and towing fees shall have been paid by the owner

         

Section  IX.

            Any person violating any provisions of this Chapter shall, upon conviction in a court of competent jurisdiction, be fined  not less than Ten Dollars [$10.00] or more than Fifty Dollars [$50.00] together with the costs of prosecution.

        

        

This Ordinance shall take effect twenty [20] days after its passage.
